As vehicles move from driver assistance systems to fully autonomous driving, a simple question becomes deeply complicated:

Who is criminally responsible when a self-driving car causes an accident?

In a conventional car crash, criminal law looks at the human driver: Did they drive recklessly, exceed the speed limit, ignore traffic rules, or drive under the influence? With autonomous vehicles, however, the “driver” may be a combination of software, sensors, manufacturers, fleet operators and, sometimes, a human occupant who is not actively controlling the car.

This article examines how criminal responsibility might be allocated in self-driving car accidents. It explores different levels of automation, the shifting concept of “control”, the roles of human occupants and corporate actors, and the evidentiary challenges that criminal justice systems will face.


1. Levels of Automation and the Idea of “Control”

Debates about criminal liability cannot be separated from the technical level of automation. A useful starting point is the widely used classification:

  • Level 0–1: No or minimal automation. The human driver controls the vehicle; assistance systems support (e.g. adaptive cruise control).
  • Level 2 (partial automation): The system can control steering and speed simultaneously, but the human must supervise continuously and be ready to intervene.
  • Level 3 (conditional automation): The system performs driving tasks in certain conditions; the human is a fallback, but may be allowed to disengage attention until requested.
  • Level 4 (high automation): The vehicle can drive itself in defined conditions (geofenced areas, specific routes) without human intervention; if it fails, it is expected to reach a safe state.
  • Level 5 (full automation): No human driving required in any condition.

Criminal law traditionally links responsibility to control over the risk. In Level 0–2 systems, the human still has clear control; in Level 4–5, control is effectively delegated to the system and its designers and operators. Level 3 is a grey zone, where the line between human and system control is particularly contested.


2. Human Occupant Liability: When Is “Driver” Still a Driver?

Even in highly automated cars, there may be a human in the driver’s seat. The key question is:

What is the human reasonably expected to do, given the system’s design and instructions?

Several scenarios illustrate the spectrum:

  1. Level 2 assistance misused as full autonomy
    • The system requires constant human supervision, but the driver checks their phone, sleeps or moves to the passenger seat.
    • If an accident occurs, many legal systems are likely to treat this as negligent or even reckless driving, since the driver ignored clear warnings and misused the system.
  2. Level 3 – failed handover
    • The system drives, then requests human takeover in an emergency; the occupant fails to respond in time.
    • Liability depends on whether the system gave adequate and timely warning, and whether it was realistic to expect the human to regain situational awareness quickly. If the technology pushes human capabilities to their limits, placing full blame on the occupant may be unfair.
  3. Level 4–5 – no expectation of human control
    • The vehicle is marketed and certified as “no human driving needed” within a defined area or mode.
    • Here, treating the human occupant as a “driver” in the traditional sense becomes artificial. Criminal responsibility for driving errors may have to shift away from the occupant.

In short, the more the system invites the human to disengage, the weaker the basis for blaming that human for failing to intervene.


3. Manufacturers and Software Developers: From Product Defect to Criminal Fault

When an autonomous vehicle causes harm due to software errors, sensor failures or flawed design, attention turns to manufacturers and developers. Civil law has long recognized product liability for defective products, but criminal liability is a more controversial step.

Criminal responsibility for manufacturers and developers typically requires:

  • A breach of a duty of care in design, testing or deployment (e.g. ignoring known safety issues, skipping critical tests),
  • A foreseeable risk of death or serious injury,
  • A degree of negligence (or recklessness) that surpasses ordinary error.

Examples of potentially criminal conduct might include:

  • Deploying an autonomous driving update despite internal reports of serious safety flaws,
  • Manipulating safety tests or misrepresenting system capabilities to regulators,
  • Systematically sacrificing safety margins to gain market advantage.

In such cases, criminal law could reach not only individual engineers, but also corporate entities and senior management who made or endorsed those decisions.


4. Fleet Operators and Mobility Platforms

Many self-driving vehicles will not be privately owned but will operate as part of robotaxi fleets, logistics services or shared mobility platforms. These operators:

  • Decide when and where vehicles operate,
  • Maintain the hardware and software,
  • Configure operational policies (speed limits, weather conditions, geofencing).

If a fleet operator knowingly configures systems to drive under unsafe conditions (e.g. heavy fog, untested roadworks) or neglects required updates and maintenance, they may be criminally liable under theories similar to those used for unsafe industrial operations.

Criminal law in this area is likely to focus on:

  • Organisational fault – were there adequate safety procedures, monitoring and incident response?
  • Systemic negligence – was the operator ignoring repeated warnings or incident patterns?
  • Corporate culture – did management push for aggressive deployment at the expense of safety?

5. The Problem of Causation and the “Black Box”

Self-driving cars rely on complex stacks of software and sensors. After an accident, the big question is:

What exactly went wrong – and whose decision caused it?

Challenges include:

  • Multi-factor causation
    • Human behaviour (e.g. other drivers, pedestrians), weather conditions, road defects and sensor errors may all interact.
    • Isolating the contribution of the autonomous system, versus other factors, is difficult.
  • Software opacity
    • Machine learning components may not have a simple “if-then” logic.
    • Explaining why a particular manoeuvre occurred (e.g. lane change, braking decision) may require expert interpretation of logs and model behaviour.
  • Data control
    • Manufacturers and fleet operators often control access to logs and internal documentation.
    • Without robust disclosure obligations, prosecutors and victims may be unable to prove fault beyond reasonable doubt.

Criminal law may need new rules on mandatory event data recorders, logging, and disclosure for autonomous vehicles, so that courts can reconstruct what happened and fairly assign responsibility.


6. Corporate Criminal Liability in Autonomous Driving

As vehicles become more autonomous, the centre of gravity of criminal responsibility may shift from individuals to organisations. Corporate criminal liability frameworks can play a central role:

  • Companies can be held liable for offences committed by employees, or for systemic failures in safety management.
  • Sanctions can include fines, compliance orders, operational restrictions and, in extreme cases, bans on marketing certain systems.

Key questions for corporate liability include:

  • Did the company have a proper safety management system for its autonomous vehicles?
  • Were internal warnings or near-miss incidents ignored or suppressed?
  • Did marketing materials mislead users about the true level of automation and required human attention?

Criminal law’s goal here is not only punishment but also deterrence and cultural change, encouraging companies to treat safety as a non-negotiable priority.


7. Future Directions: Redesigning Traffic Criminal Law

Self-driving cars will likely require recalibration of traffic-related criminal law, not its abolition. Possible directions include:

  • New offence structures
    • Moving from driver-centric offences (“dangerous driving”) to system-centric offences (“placing an unsafe autonomous driving system into public traffic”).
  • Shared responsibility frameworks
    • Recognizing that responsibility may be shared between human occupants, manufacturers and operators, depending on the level of automation and specific circumstances.
  • Stronger regulatory–criminal interaction
    • Using safety regulations (certification, software update approvals, mandatory reporting) as a basis for criminal liability when rules are deliberately or grossly violated.
  • International harmonisation
    • Autonomous vehicles will cross borders; conflicting liability rules could complicate deployment. Some convergence on minimum safety and liability standards may be necessary.

Conclusion: No Driver, But Still Someone Responsible

Self-driving cars do not eliminate criminal responsibility; they redistribute it. As control shifts from human drivers to complex socio-technical systems, criminal law must adapt:

  • In lower levels of automation, human drivers remain central, especially when they misuse assistance systems.
  • In higher levels, responsibility increasingly falls on manufacturers, software developers and fleet operators, whose design and governance decisions shape the risks on the road.
  • Corporate criminal liability and robust evidentiary frameworks will be crucial to ensure accountability.

The core principle remains unchanged: wherever a dangerous activity is introduced into public space, someone must bear responsibility for managing its risks. In the era of autonomous vehicles, the task of criminal law is to identify that “someone” – or that “some organisation” – without stifling beneficial innovation, but without allowing safety to become an optional feature.
