Punishing AI: Conceptual and Practical Challenges

Introduction: Can You Punish a Machine?

As artificial intelligence (AI) systems increasingly influence real-world outcomes, legal scholars have begun to ask a difficult question: if an AI system causes serious harm, can – or should – we “punish” the AI itself?

At first glance, the idea sounds intuitive. If the system “acted” wrongly, perhaps it should be shut down, restricted, or “sanctioned” in some way. Yet, when we look more closely, punishing AI raises deep conceptual and practical challenges. Criminal law was built around human beings — conscious, moral agents who can understand blame. Machines are something else.

This article examines whether it makes sense to speak of punishing AI, explores how traditional theories of punishment apply (or fail to apply) to AI systems, and considers what sanctions in AI contexts should really target.


1. Why We Punish: Classical Theories and Their Human Focus

To assess whether AI can be punished, we must first remember why criminal law punishes at all. Main theories include:

  • Retribution – imposing suffering on the offender because they deserve it;
  • Deterrence – discouraging future crime by making an example;
  • Incapacitation – protecting society by removing the offender’s ability to cause harm;
  • Rehabilitation – reforming the offender;
  • Expressive/communicative theories – publicly condemning wrongful conduct and reaffirming shared values.

All of these rest on the assumption that the offender is:

  • A moral agent,
  • Capable of understanding norms and censure,
  • Able to change future behavior in response to punishment.

AI systems lack consciousness, emotion, and moral understanding. This immediately calls into question whether punishment in the traditional sense is even conceptually possible.


2. Conceptual Challenge 1: No Moral Agency, No Desert

Retributive theories say punishment is justified when an offender deserves it. Desert requires:

  • Knowledge of the norm,
  • Capacity to act otherwise,
  • Moral responsibility for choosing the wrongful act.

AI systems:

  • Do not understand right and wrong,
  • Follow optimization rules without moral evaluation,
  • Cannot feel guilt, shame, or remorse.

Under a retributive lens, AI cannot truly be a bearer of desert. Any “punishment” imposed on AI would lack the core moral justification that underpins criminal sanctions against humans. It becomes a misapplied concept: we may switch off or reprogram a system, but we are not punishing a morally responsible agent.


3. Conceptual Challenge 2: Sanctions Without a Subject

Even from consequentialist (forward-looking) perspectives like deterrence or rehabilitation, punishing AI is problematic.

  • General deterrence aims to send a message to potential offenders. But AI cannot “receive” the message — only humans can.
  • Special deterrence seeks to discourage the same offender from reoffending. But AI does not choose based on fear of future punishment; it follows code.
  • Rehabilitation tries to morally reform the offender. Updating an algorithm is not moral reform; it is technical adjustment.

In all cases, the real audience of any sanction is human: developers, companies, users, regulators, and the public. Saying we punish AI risks confusing the target of criminal law’s communicative function.


4. Practical Challenge 1: What Would “Punishing AI” Look Like?

Even if we ignore philosophical concerns, punishing AI presents serious practical difficulties.

Possible “sanctions” might include:

  • Deactivation – shutting the system down;
  • Restriction – limiting its scope, capabilities, or domains of operation;
  • Modification – forcing updates, retraining, or architectural changes;
  • Registration and monitoring – requiring special oversight and reporting.

But all of these are, in reality, sanctions on the humans and organizations that own, control, or operate the AI:

  • Deactivation may destroy an asset and business model,
  • Restrictions may block profitable uses,
  • Mandatory modifications impose costs and compliance burdens.

We quickly see that punishing AI means regulating and constraining human behavior via the AI’s technical status. The machine itself remains indifferent.


5. Practical Challenge 2: Risk of Symbolic Scapegoating

Another risk is that “punishing AI” becomes pure symbolism:

  • A harmful system causes serious damage,
  • Public outrage demands action,
  • Authorities announce that the “AI has been banned” or “decommissioned”.

On paper, the problem appears solved. But what if:

  • The same developers later build a similar system,
  • The same corporate structures remain incentivized to cut corners,
  • The root causes (governance, culture, inadequate testing) are left untouched?

In this scenario, AI punishment serves as a scapegoat. It absorbs public outrage while allowing responsible human actors to continue operating with few consequences.


6. Practical Challenge 3: Attribution and Complexity

Modern AI systems operate in complex, distributed environments:

  • Multiple entities contribute to the dataset, model architecture, and deployment,
  • Systems may be updated over time by different teams,
  • Third-party plugins and APIs may influence behavior.

When harm occurs, it may be unclear which precise version or configuration of the AI was involved, or who controlled it at that moment. Punishing “the AI” as a unitary object can obscure intricate chains of human decisions that are crucial for fair attribution of responsibility.


7. What Makes Sense Instead? Sanctioning Humans and Organizations

Given these challenges, many scholars argue that criminal sanctions should focus on human and corporate actors, not AI systems themselves.

Relevant targets for punishment include:

  • Developers and engineers who knowingly ignore safety or legality,
  • Corporate decision-makers who prioritize profit over known risks,
  • Users who exploit AI tools for criminal purposes,
  • Organizations that systematically fail to implement adequate AI governance.

Here, traditional punishment theories still apply:

  • Retribution: we punish those who deliberately or recklessly create dangerous systems.
  • Deterrence: others are discouraged from similar misconduct.
  • Expressive function: society publicly condemns irresponsible AI practices.

The AI system remains central as evidence and context, but not as the subject of punishment.


8. Sanctions About AI, Not Against AI: Regulatory–Criminal Hybrid Models

Instead of punishing AI, the law can develop hybrid models that blend regulation and criminal sanctions:

  • Ex ante regulation: licensing, risk classification (e.g., “high-risk AI”), mandatory impact assessments, transparency, and human oversight requirements;
  • Ex post criminal liability: when actors seriously violate these duties and cause harm, criminal sanctions follow.

Sanctions might include:

  • Heavy fines and remedial measures for corporations,
  • Disqualification of managers from certain roles,
  • Criminal liability for egregious or repeated violations,
  • Mandatory withdrawal or redesign of AI systems.

In this framework, measures directed at AI (e.g., withdrawal, modification) are instruments of human punishment and prevention, not punishment of the AI itself.


9. Conclusion: Don’t Punish AI – Govern It, and Punish Irresponsible Humans

The idea of punishing AI is both conceptually fragile and practically misleading. AI systems:

  • Lack moral agency,
  • Cannot experience or understand punishment,
  • Serve as instruments within human-designed socio-technical systems.

Criminal law should therefore resist framing AI as a true subject of punishment. Instead, it should:

  • Punish human and corporate actors who design, deploy, and misuse AI irresponsibly,
  • Use measures about AI (shutdowns, restrictions, redesigns) as tools to protect society,
  • Maintain a clear narrative that responsibility remains human-centered.

In short, we should not ask how to punish AI, but rather how to govern AI and whom to punish when AI is involved in serious wrongdoing. The answer, in the end, is still: people and organizations, not machines.
