Divorce, Custody, and Alimony Disputes in International Marriages: Turkish and International Legal Perspectives

1. Legal Framework

Disputes arising from international marriages—such as divorce, child custody, and alimony—are governed by both the Turkish Civil Code (TCC) and the Turkish Private International and Procedural Law No. 5718 (PILPA / MÖHUK).

Other relevant instruments include:

  • UN Convention on the Rights of the Child (CRC)
  • The Hague Conventions (particularly the 1980 Hague Convention on Child Abduction)
  • European Convention on Human Rights (ECHR)

2. Divorce with a Foreign Spouse: Jurisdiction and Applicable Law

🔹 Jurisdiction:

Turkish courts have jurisdiction when:

  • One of the spouses resides in Turkey
  • The marriage is to be dissolved in Turkey
  • One of the spouses is a Turkish citizen

📌 Divorce petitions are filed with Family Courts.

🔹 Applicable Law (PILPA Article 14):

  • If the spouses share a common nationality, that law applies.
  • If they have different nationalities, the law of their common habitual residence applies.
  • If none of the above applies, Turkish law governs the divorce.

3. Recognition and Enforcement of Foreign Divorce Judgments in Turkey

Foreign divorce decrees are not automatically valid in Turkey.

Recognition (Tanıma):

To have the foreign divorce judgment recognized:

  • An application must be filed with the Turkish court
  • If both parties agree, a notarized declaration may suffice for recognition via civil registry offices

Enforcement (Tenfiz):

If the judgment includes alimony, compensation, or property division, enforcement proceedings are required under Turkish law.


4. Child Custody and the Best Interests of the Child

🔹 Applicable Law (PILPA Article 20):

  • Custody matters are governed by the law of the child’s habitual residence.
  • If the child lives in Turkey, Turkish law applies.

🔹 Best Interests Principle:

All custody decisions are made in line with the best interests of the child, regardless of nationality.

📌 Custody cases can be brought together with or separately from the divorce case.


5. Alimony (Spousal and Child Support)

🔹 Spousal Alimony:

  • Turkish law provides for alimony to be awarded to the spouse who will fall into financial hardship due to divorce
  • The court considers fault and financial need

🔹 Child Support (Participation Alimony):

  • Awarded to cover the child’s education, health, and basic needs
  • Payable by the non-custodial parent

📌 Turkish law is generally applied to alimony matters, unless there is a valid alimony agreement governed by a different law.


6. Hypothetical Case Study

Scenario: Ayşe, a Turkish citizen, marries Jean, a French citizen, in Paris. After five years, she returns to Turkey with their child. She wants a divorce and seeks custody and alimony.

Process:

  • Since there is no common nationality, and she resides in Turkey, Turkish law applies
  • The child resides in Turkey, so custody is determined under Turkish law
  • Ayşe files for child support and spousal alimony from Jean
  • If Jean had already obtained a divorce judgment in France, recognition and enforcement in Turkey would be required

Family law disputes in international marriages require careful legal handling, particularly when children, property, and different national laws are involved.
