As artificial intelligence (AI) systems take more autonomous decisions, a controversial idea has emerged in legal scholarship: “machine intent”. Some argue that we should treat AI systems as if they have a kind of intent or mental state, at least for legal purposes. Others insist that this is a dangerous fiction that undermines human responsibility.

The central question is simple but profound: is machine intent just an imaginative metaphor, or is it a legal necessity for dealing with AI-related harms in criminal law?

This article explores the concept of machine intent, the arguments for and against using it, and whether criminal law really needs such a construct to function in an AI-driven world.


1. What Is “Intent” in Criminal Law?

In classical criminal law, intent (mens rea) is a human mental state:

  • The actor wants a specific result, or
  • Knows that the result is virtually certain and nonetheless acts.

Intent is tied to:

  • Conscious awareness,
  • Understanding of norms,
  • Capacity to choose between alternatives.

Intent justifies blame and punishment because the actor could have acted otherwise and chose to do wrong. This rich moral content is what makes intent one of the highest forms of culpability.

AI systems, however, do not experience desire, belief, or choice in the human sense. They optimize functions and process data. So where does “machine intent” even come from?


2. What Do People Mean by “Machine Intent”?

The term “machine intent” is usually not meant literally. It is used to describe goal-directed behavior of AI systems that:

  • Act consistently to achieve programmed objectives (e.g., maximize clicks, minimize error, optimize profit),
  • Select among alternative actions based on optimization criteria,
  • Produce patterns of behavior that appear as if the system has “preferences”.

In this functional sense, machine intent refers to:

  • The objective function embedded in the system,
  • The way the system prioritizes outcomes,
  • The observable regularities in its behavior.

Supporters say: if the law can treat corporations as having “corporate intent” based on organizational behavior, perhaps it can treat AI as having machine intent based on algorithmic behavior.


3. Arguments for Machine Intent as a Legal Construct

Proponents of machine intent do not usually claim that machines literally have minds. Instead, they present machine intent as a legal fiction or analytical tool.

3.1. Making Complex Systems Legally Manageable

AI systems can be extremely complex:

  • Neural networks with millions of parameters,
  • Self-learning systems that evolve over time,
  • Interactions of multiple algorithms in large platforms.

In such environments, tracing individual human intentions for every harmful outcome is often impractical. Machine intent is proposed as a way to:

  • Treat the AI system as a unit of analysis,
  • Attribute “intent” to the system’s behavior pattern,
  • Simplify liability discussions where many human and technical factors intersect.

3.2. Enabling Coherent Doctrinal Categories

Criminal law’s categories — intent, recklessness, negligence — are built around mental states. When AI is involved, the risk is that doctrinal coherence breaks down: we talk about harm, but we lose the language of culpability.

By introducing machine intent, the law could:

  • Retain familiar categories (e.g., “the system intentionally prioritized harmful content”),
  • Develop doctrines around the foreseeable behavior of systems,
  • Maintain a structured way of distinguishing between levels of risk and culpability.

3.3. Bridging the Gap to Corporate and Organizational Intent

We already use fictional or constructed intent for corporations:

  • Corporate intent is inferred from the acts and knowledge of employees and managers,
  • No single human may hold all the relevant information,
  • Yet the law still speaks of “the company’s intention”.

Supporters argue that machine intent is similar: a construct based on system behavior, used to allocate responsibility, even if there is no real “mind” behind it.


4. Arguments Against Machine Intent: Fiction with Dangerous Side Effects

Critics of machine intent argue that the concept is not only inaccurate but dangerous.

4.1. Confusing Agency and Instrumentality

At a fundamental level, AI systems are instruments, not agents:

  • They do what they are designed and trained to do,
  • They operate within constraints set by humans,
  • They have no independent moral perspective.

Attributing intent to machines risks obscuring the fact that humans design, deploy, and profit from these systems. If we say “the machine intended X”, we may ignore the human decisions that made X likely or inevitable.

4.2. Diluting Human Responsibility

Machine intent can become a convenient shield for companies and designers:

  • “We didn’t intend this — the system developed that behavior”,
  • “The AI decided; we only provided the infrastructure.”

By talking about machine intent, we may inadvertently create a narrative of inevitability, where harmful outcomes seem to be the product of autonomous machine will rather than human choices. This can weaken incentives to design, test, and govern AI responsibly.

4.3. Undermining the Moral Foundations of Criminal Law

Criminal liability is not just about managing risk; it is also about moral condemnation. Punishing someone presupposes:

  • They knew or could have known what they were doing,
  • They could have acted differently,
  • They deserve blame.

Machine intent does not meet these conditions. It is a pure metaphor, without moral substance. Building criminal doctrine on such metaphors risks hollowing out the concept of culpability, making punishment more arbitrary and less justifiable.


5. Do We Really Need Machine Intent for Criminal Liability?

The crucial question is whether we must embrace machine intent to handle AI-related crime, or whether human-centered concepts are sufficient.

5.1. Focusing on Human Mental States Around AI

Instead of attributing intent to machines, we can:

  • Analyze whether developers intentionally designed systems in ways that create unlawful outcomes,
  • Examine whether companies knowingly tolerated harmful behaviors,
  • Assess whether users deliberately misused AI tools for criminal purposes.

Here, AI remains an instrument; the intent lies in the human sphere. The fact that a system is complex or self-learning does not erase the mental states of those who created and deployed it.

5.2. Using Recklessness and Negligence for Systemic Risks

Many AI-related harms are better captured by recklessness or negligence:

  • Recklessness: conscious disregard of substantial risks from deploying high-risk AI systems,
  • Negligence: failure to meet evolving standards of care in design, testing, and oversight.

These concepts do not require pretending that machines intend anything. They focus on what humans knew or should have known about system behavior.

5.3. Corporate and Organizational Culpability

Complex AI systems are typically built and deployed by organizations. Instead of machine intent, we can rely on:

  • Corporate criminal liability,
  • The idea of organizational fault: policies, cultures, and structures that incentivize ignoring risk,
  • Duties of governance and oversight for AI.

This approach preserves the essential link between culpability and human decision-making, even in large and diffuse structures.


6. A Narrow, Descriptive Use of “Machine Intent”?

There may be one acceptable, limited role for the notion of machine intent: as a descriptive, analytical shorthand, not as a true legal category.

Under this narrow view:

  • “Machine intent” is just a way to describe what the system is optimized to do,
  • It helps courts and regulators understand why a system repeatedly behaves in a harmful way,
  • It never replaces the need to identify human actors with legal responsibility.

For example, a court might say:

“The system was designed with the ‘intent’ to maximize user engagement, leading it to consistently prioritize extreme content.”

But in legal terms, this simply means:

  • Human designers and companies chose that objective,
  • They are responsible for how that choice played out in practice.

In other words, machine intent may be heuristic language, but culpability remains human.


7. Conclusion: Fiction is Not Necessity — Keep Intent Human

So, is machine intent a fiction or a legal necessity? The answer is more nuanced than a simple yes or no:

  • It is a fiction — machines lack consciousness, moral agency, and genuine mental states.
  • It is not a necessity — criminal law can function by focusing on human intent, recklessness, and negligence, supplemented by corporate liability and regulatory duties.

If used at all, “machine intent” should be treated as descriptive shorthand for design choices and optimization goals, not as a real carrier of culpability.

In the end, the law must resist the temptation to project human categories of mind onto machines in a way that erodes human accountability. AI may behave as if it has intent, but criminal intent — in the sense that justifies punishment — still belongs only to human beings and human organizations.
