Real Estate Investment ın Turkey

In the Cadastre Law published under the number 28296 on 18 May 2012 in the Official Gazette No. 6302 a place is given to the part which includes estate acquisition of foreigners and principles related to legal rights for real estate acquisition in Turkey.

The condition of compliance with the legal restrictions, international bilateral relations in the direction of the country and the citizens of the countries designated by the Council of Ministers in cases required by the interests of foreign real person can acquire rights to real property and limited real in Turkey. The total area of immovable property acquired by foreign real persons and the limited real rights of independent and permanent nature shall not exceed ten percent of the district face measurement pertaining to private property and thirty  per country. The Council of Ministers is authorized to increase the amount that can be acquired throughout the country by two times.

In foreign countries, legal entities established according to the laws of their countries can only acquire real and limited real rights within the framework of special provisions. Except those trading companies, the real estate cannot be acquired and limited real rights cannot be established in their favor. Restrictions in this article shall not apply to the immovable property pledges in favor of foreigners and natural persons.

The Council of Ministers shall mean real and limited real rights acquisitions of trade companies having legal personality established in accordance with the laws of their own countries in foreign countries, in case the interests of the country are required; country, person, geographic region, time, number, rate, type, quality, surface area and quantity can be determined, limited, partially or completely stop or prohibit. Legal entities established in accordance with the laws of their own countries and foreign real persons in foreign countries have to submit the project to be developed by the related Ministry within two years. The project shall be sent to the title deed office where the real estate is located in order to be registered to the declarations section of the deed register. The approval of the approved project within the duration is monitored by the Ministry.
