1. Legal Framework
Deportation procedures in Turkey are regulated by Articles 52 to 60 of the Law on Foreigners and International Protection No. 6458 (LFIP).
All administrative steps are carried out by the Directorate General of Migration Management (DGMM) and the relevant Provincial Directorates of Migration.
2. What Is a Deportation Order?
A deportation order (also known as removal decision) is an administrative act ordering a foreign national to leave Turkey and often imposing a re-entry ban for a certain period.
Deportation is subject to judicial review and may be appealed in court.
3. Legal Grounds for Deportation (Article 54 of LFIP)
Mandatory Grounds for Deportation:
- Being a member of a terrorist organization or criminal syndicate
- Posing a threat to public order or national security
- Using false or forged documents for visa or residence
- Working without a valid work permit
- Entering or exiting Turkey illegally
- Overstaying visa or residence permit by more than 10 days
- Remaining in Turkey without a valid residence permit
- Being released from prison after serving a sentence
Discretionary Grounds (Subject to Administrative Assessment):
- Threat to public health
- Violating visa conditions
- Associating with banned individuals
- Assisting irregular migrants
4. Who Cannot Be Deported? (Article 55 of LFIP)
Deportation cannot be ordered for the following categories:
- Foreigners with serious health conditions receiving treatment in Turkey
- Pregnant women
- Victims of human trafficking receiving protection
- Individuals who are elderly, disabled, or at risk of inhumane treatment in their country
- Applicants for international protection (until decision is finalized)
📌 These individuals may instead be subjected to “alternative obligations to administrative detention” such as residing at a fixed address, reporting requirements, or financial guarantees.
5. How Does the Deportation Process Work?
- Detection / Apprehension:
Police or DGMM identifies a deportation ground. - Issuance of Removal Order:
The Provincial Directorate of Migration Management issues the decision. - Official Notification:
The deportation order is served in writing to the foreigner and/or their attorney. - Detention (if necessary):
The foreigner may be placed in a Removal Center (GGM) under administrative detention. - Appeal Process:
The foreigner has the right to appeal within 7 days of notification.
Once an appeal is filed, the deportation is suspended until the court rules.
6. Right to Appeal and Judicial Procedure
Where to File the Appeal:
- Administrative Court in the province where the deportation order was issued.
Deadline:
- Within 7 days of the written notification
- This is a strict deadline; late appeals are dismissed.
Procedure:
- The appeal may be filed personally or via an attorney.
- A request for stay of execution (interim suspension) can be included.
- The Administrative Court’s decision is final; there is no higher appeal.
7. When Can a Deported Foreigner Return to Turkey?
A deported person is typically subject to a re-entry ban ranging from 1 to 5 years.
However:
- It is possible to apply for an exceptional visa
- In special cases (e.g., marriage, health, humanitarian concerns), a governor’s permit can be requested
- Foreigners may re-enter with special authorization or after ban expiry
🔁 Most return cases require consular visa applications and justification.
8. Case Example
Scenario: Samuel, a Nigerian citizen, is caught working without a valid work permit. His visa had expired 45 days earlier.
Process:
- A deportation order is issued against him
- He is placed in a removal center (GGM)
- His attorney files an appeal within 7 days at the Administrative Court
- During the court case, the deportation is suspended
- The court rules in favor of Samuel, considering his pending work permit application, and cancels the removal decision
9. Conclusion and Legal Assessment
Deportation orders are serious administrative actions that directly affect fundamental human rights, such as the right to liberty, family life, and personal safety.
Incorrect, disproportionate, or procedurally flawed deportation decisions can be overturned by the judiciary.
