Fraud, Overcharging and Tourist Victimisation in Turkey: Your Criminal and Civil Rights

Foreign visitors in Turkey sometimes face classic “tourist scams”:

  • Restaurants or night clubs presenting extremely inflated bills,
  • Taxi drivers taking the long route, refusing to use the meter or playing the “wrong change” trick,
  • Unlicensed tour guides and fake travel agencies,
  • “Night club traps” where drinks are added to the bill and credit cards are skimmed or cloned.

Under Turkish law, these are not “normal tourist experiences” but can amount to criminal offences (fraud, theft, misuse of credit cards) and, at the same time, consumer law violations giving you the right to refunds and compensation.


1. Criminal Law Dimension: Fraud, Theft and Credit Card Abuse

The core offence is fraud (dolandırıcılık), regulated by Articles 157–158 of the Turkish Penal Code. A person who, through fraudulent behaviour, deceives someone and gains an unjust benefit to that person’s detriment can face 1–5 years of imprisonment plus a judicial fine; aggravated forms (for example, by using business premises or information systems) carry higher penalties.

Examples in the tourist context:

  • A bar or “night club” luring tourists with free entry, then adding fabricated items to the bill and pressuring them to pay.
  • Taxi drivers deliberately using manipulated meters, or agreeing a low price then demanding a much higher sum once the ride is over.
  • Fake travel agencies selling non-existent tours or tickets.

Where bank or credit cards are copied and used without consent, this may constitute credit card fraud or IT-related fraud, an aggravated form of fraud under the Penal Code.

In addition, stealing cash or valuables during these encounters (pickpocketing, taking the card and later using it) will usually amount to theft or qualified theft.

If you are a victim:

  • You can file a criminal complaint at the nearest police station or public prosecutor’s office.
  • Ask for a copy or reference number of your statement and keep any receipts, bank slips, screenshots, photos or videos as evidence.
  • You may join the criminal case as a complainant / injured party and request compensation within the criminal proceedings, although in practice civil or consumer proceedings may still be needed.

2. Consumer Law Dimension: Overcharging and Unfair Commercial Practices

Tourists using restaurants, taxis, hotels, tour services or travel agencies are protected by Law No. 6502 on the Protection of Consumers. This law aims to protect consumers’ economic interests, compensate their losses and prevent unfair commercial practices.

Key points:

  • You are a consumer if you are using a service for personal (non-professional) purposes.
  • The restaurant, taxi company, tour operator or agency is a supplier of services.
  • Practices such as unfair pricing, hidden charges, misleading information about the service, or failure to provide the promised service can be violations of consumer law.

In case of an excessive or fraudulent bill:

  1. Ask for an itemised invoice or receipt. In Turkey many businesses are legally obliged to issue a fiscal receipt.
  2. If you have already paid, keep the receipt and any evidence of what was initially promised (menu photos, price list, tour brochure, website screenshots).
  3. You may file a complaint with:
    • local consumer arbitration committees (for lower-value disputes), or
    • consumer courts (for higher amounts or complex cases).

Foreign tourists have the same consumer rights as Turkish citizens. A lawyer can pursue the case on your behalf even after you leave Turkey, based on a power of attorney.


3. Unlicensed Guides and Fake Agencies

Tour guiding in Turkey is a regulated profession; guides must be licensed and registered, and travel agencies must hold proper authorisation. Using unlicensed guides or fake agencies increases the risk of:

  • Non-delivery of the promised service (no tour, different route, low-quality organisation),
  • Overcharging or last-minute “extras”,
  • Fraudulent behaviour such as collecting cash and disappearing.

From a legal standpoint, these scenarios can be both fraud under the Penal Code and defective or non-performed service under consumer law, entitling you to cancellation, refund and possibly further damages.


4. How Criminal and Civil Routes Work Together

It is important to understand that criminal and civil/consumer remedies are separate but complementary:

  • Criminal complaint aims to punish the offender and may result in imprisonment or fines.
  • Consumer or civil actions aim to get your money back and obtain compensation (for example, the difference between the fair price and the amount you paid, plus possibly moral damages in serious cases).

In many cases:

  • The criminal file (police report, CCTV, witness statements) provides valuable evidence for the consumer or civil case.
  • A conviction for fraud strongly supports your compensation claim, but even without a conviction, you may win a civil case based on contracts and consumer rules, which have a lower standard of proof.

Because most tourists leave Turkey quickly, it is usually advisable to:

  • File a police report immediately;
  • Inform your consulate;
  • Collect all documentary evidence;
  • Consider appointing a lawyer specialised in criminal and consumer law to follow up after your departure.

5. Practical Tips to Reduce Risk

  • Avoid venues with no visible price list or that refuse to show a menu with prices in advance.
  • In taxis, insist on the meter being turned on and avoid drivers who refuse or suggest “special prices”.
  • Use reputable, licensed tour guides and agencies; check registration numbers where possible.
  • For card payments, ask that the terminal be brought to your table, check the amount before entering your PIN, and keep POS slips.

Being aware of these schemes and your legal rights allows you to react calmly, protect your evidence and pursue both criminal justice and financial redress if you become a victim.
