Social media platforms and liability rules in Turkey are governed by a layered legal framework rather than a single platform law. The core statute is Law No. 5651 on the Regulation of Publications on the Internet and Combating Crimes Committed Through Such Publications, but the legal analysis also interacts with the Turkish Constitution, the Personal Data Protection Law No. 6698, and the implementing Principles and Procedures on Social Network Providers adopted by the Information and Communication Technologies Authority, known as BTK. For global platforms, local startups, media companies, and digital-service operators, the key point is that Turkish law does not treat social media merely as a neutral technology business. It treats large platforms as regulated internet actors with specific compliance, reporting, representative, user-rights, data, and enforcement duties.
The constitutional framework explains why this field is so important and so contested. Article 26 of the Constitution protects freedom of expression and the liberty to receive and impart information without interference by official authorities, while allowing restrictions for aims such as national security, public order, prevention of crime, protection of the reputation and rights of others, and protection of private life. Article 28 adds that the press is free and shall not be censored. In practical terms, Turkish platform regulation is built on a continuing balance: the state may regulate harmful or unlawful online content, but those restrictions must still coexist with expression and information freedoms.
What counts as a social network provider under Turkish law
The starting point is definition. The current consolidated text of Law No. 5651 defines a social network provider as a natural or legal person that enables users to create, view, or share content such as text, images, sound, or location data on the internet for purposes of social interaction. That definition is deliberately functional. Turkish law is looking at what the service enables users to do, not only what the company calls itself.
At the same time, the BTK’s 2023 Principles and Procedures narrow the field in an important way. They state that the rules are aimed at social network providers and that their application does not remove any liability the same actor may already have as a content provider or hosting provider. They also say that real or legal persons who include social-interaction content only in a limited part of their internet activity are not treated as social network providers for these rules, and that platforms such as personal websites, e-commerce websites, and news sites are outside scope where social-interaction content is only a secondary or ancillary service. This means not every site with a comment box or share button falls into the social-network-provider regime.
That distinction matters because Turkish internet law regulates different actors differently. Under Articles 4, 5, and 6 of Law No. 5651, content providers are responsible for the content they make available online, hosting providers are not under a general duty to monitor hosted content or investigate illegality but must remove unlawful content when notified under the law, and access providers must block access when they are properly notified under the statute and must retain traffic data for defined periods. So, before platform-specific rules even begin, Turkish law already uses a differentiated intermediary-liability structure.
The Turkish model is not pure immunity and not pure publisher liability
A useful way to understand social media platforms and liability rules in Turkey is to reject both extremes. Turkish law does not create a full safe-harbor model in which platforms are always neutral and insulated, but it also does not automatically treat platforms as publishers of everything users post. Instead, it starts from role-based obligations. A platform may be treated as a hosting actor for some purposes, a social network provider for others, and, in specific contexts, a directly responsible actor once it has been notified of unlawful content or ordered to act. That structure has become much stricter for large platforms. The Turkish legislature and BTK have moved beyond the old model of simple notice-and-blocking. Representative appointment is a cornerstone obligation
One of the best-known platform duties in Turkey is the representative requirement. The current 5651 text, as translated in the available English translation, states that foreign social network providers with more than one million daily accesses from Turkey must designate at least one representative in Turkey, display that representative’s contact information in a clearly visible and directly accessible way on their website, and notify the Authority of the representative’s identity and contact details. The BTK’s implementing rules further require supporting documents to be filed with the Authority and state that if the representative is a real person, documents must show that the person is both a Turkish citizen and resident in Turkey.
This is not a symbolic requirement. The representative is meant to ensure that notifications, requests, memoranda, and user applications under the statute can be handled locally and that other legal obligations can be fulfilled in Turkey. In practice, the rule gives Turkish authorities and users a domestic contact point rather than forcing every procedural step through a foreign headquarters. That makes the representative obligation one of the foundations of Turkish platform accountability.
Sanctions for not appointing a representative are severe
Turkey also backs the representative requirement with a cascading sanction model. The BTK rules state that if a social network provider fails to comply after notice, the BTK President may impose an administrative fine of TRY 10 million, and if non-compliance continues for another thirty days after service of that fine, a further TRY 30 million administrative fine may be imposed. If the platform still does not comply within thirty days after the second fine, new advertising from Turkish resident taxpayers can be banned. If non-compliance continues for three months after the ad-ban decision, the BTK President may ask the criminal judgeship of peace to reduce the platform’s internet bandwidth by 50%, and after continued non-compliance the reduction may rise to up to 90%, though the judge may set a lower figure so long as it is not below 50%. The implementing rules also state that court decisions on bandwidth reduction must be implemented by access providers immediately and no later than four hours after notification.
This progressive structure shows how seriously Turkey treats platform localization and responsiveness. The system begins with notice and fines, then moves to advertising restrictions, and ultimately reaches technical degradation of the service. It is not designed merely to punish; it is designed to force compliance. The same rules also state that if the platform later fulfils the representative obligation, only one quarter of the fines are collected, the advertising ban is lifted, and the judicial bandwidth-reduction decisions automatically lose effect. That “compliance off-ramp” is part of the Turkish enforcement model as well.
Complaint handling and response times
For large platforms, Turkish law imposes direct complaint-response duties. The implementing rules state that social network providers with more than one million daily accesses from Turkey must respond to applications made by persons regarding content falling within the law’s relevant complaint mechanisms, must make those applications easy to submit, and must provide a Turkish-language option. The platform must answer within forty-eight hours, either positively or negatively, and negative answers must be reasoned. Turkish-language applications must also be answered in Turkish.
This is a major operational duty because it turns user complaints into a regulated workflow rather than a voluntary trust-and-safety feature. The same rules also provide that failure to comply with the complaint-response obligation can lead to a TRY 5 million administrative fine. BTK may assess complaints in reporting periods and evaluate, among other things, whether the platform built the systems needed to comply effectively, whether it systematically responded negatively to particular persons or institutions, whether it systematically violated statutory timelines, and whether negative answers were unreasoned. This makes the quality of the platform’s moderation and complaint process legally relevant, not just reputationally relevant.
Transparency reports and algorithm-related disclosures
Turkey also requires large social platforms to produce recurring transparency reports. The current 5651 text and BTK rules state that social network providers over the threshold must submit Turkish-language reports every six months containing statistical and categorical information on the implementation of content-removal and/or access-blocking decisions and on the handling of user applications. The rules further specify the timing of those reports and require the part concerning user applications to be published on the platform’s own website after removal of personal data.
The platform’s reporting obligations go beyond raw takedown numbers. The English translation of the law states that the reports submitted to the Authority must also include information on algorithms, advertising policies, and transparency policies concerning title tags, featured content, and access-reduced content. The BTK rules similarly require platforms to act in line with the principle of accountability, ensure transparency, and provide necessary information and documents when requested. This means Turkish platform regulation reaches not only visible outcomes but also the systems that shape recommendation and prominence.
Advertising libraries and ad transparency
A distinct feature of the Turkish framework is the advertising library requirement. The BTK rules state that a social network provider with more than one million daily accesses from Turkey must establish an advertising library. That library must include the content of the advertisement, its type, the advertiser, the period during which the ad remained published, the target audience and the parameters used to identify it, and the number of persons or groups reached by the ad. The same rules require the ad library to be placed on the platform’s website in a way that is directly accessible and easy to see. Failure to comply can trigger a TRY 10 million administrative fine.
This is an important point for social media platforms and liability rules in Turkey because it shows that Turkish law is not limited to illegal-content response. It also regulates transparency in platform advertising architecture. In practice, this affects political advertising, issue advocacy, influencer amplification, microtargeted commercial campaigns, and any other ad systems that rely on opaque targeting or short-lived delivery. The Turkish state is effectively demanding a public-facing accountability tool for platform advertising.
Direct civil liability after judicial notice
One of the strongest platform-liability provisions in the current law is the rule on post-notification civil responsibility. The consolidated text of Law No. 5651 states that if the unlawfulness of content has been determined by a judge or court decision, and the social network provider still fails to remove the content or block access within twenty-four hours after notification, the platform becomes liable for the resulting damages. The law expressly adds that the injured party does not first need to pursue the content provider or sue the content creator before pursuing the platform’s civil liability.
This is a major shift away from the idea that a platform can always hide behind user-generated content. Turkish law is saying, in effect, that once unlawfulness has been formally determined and the platform has been notified, continued inaction can create the platform’s own liability. That rule makes compliance with judicial orders and notices especially important for large platforms operating in Turkey.
Featured content, hashtags, and emergency harmful content
Turkish law also singles out visibility-enhancing tools such as title tags and featured content. The current law states that social network providers must establish, in cooperation with BTK, an effective application mechanism for removing title tags and featured content by warning method. It further states that where a crime is committed through another’s publication made available by title tags or featured content, and the unlawful content was notified to the platform but not removed immediately and at the latest within four hours, the social network provider becomes directly responsible for that content.
The law also addresses urgent threats to life and property. The consolidated text states that where the platform learns of content endangering the life or property safety of persons and there is urgency, it must share that content and information about the person who created it with the competent law-enforcement units. The BTK rules repeat the same duty. This shows that Turkish platform liability is not only about passive compliance with external orders; it also includes active escalation duties in emergencies.
Judicial-cooperation duties in serious investigations
Another major duty concerns criminal investigations into particularly serious offences. The BTK rules state that, when requested by the public prosecutor at the investigation stage or by the court at the prosecution stage, the platform’s Turkish representative must provide the information necessary to identify the perpetrators of certain online content involving offences such as child sexual abuse, public dissemination of misleading information, offences against the unity of the state and the constitutional order, and state-secrets and espionage offences. If this information is not provided, the relevant public prosecutor may apply to the Ankara criminal judgeship of peace for a 90% bandwidth reduction against the foreign social network provider.
This is one of the clearest examples of how social media platform liability in Turkey extends beyond private complaints and ordinary moderation. In the eyes of Turkish law, large platforms are also procedural actors in certain serious criminal investigations. That position increases both the compliance burden and the legal exposure of foreign-based platforms serving Turkish users.
Data localization and the KVKK connection
Data governance is another key pillar. The BTK rules state that social network providers with more than one million daily Turkish accesses must take the necessary measures to host Turkish users’ data in Turkey, and they specifically prioritize basic user information and other data that BTK may identify. The same implementing rules allow significant sanctions for failure to comply with this and other major obligations.
This duty should be read together with the Personal Data Protection Law. The KVKK states that its purpose is to protect fundamental rights and freedoms, particularly privacy, in relation to the processing of personal data, and it applies to natural and legal persons processing such data by automated means or structured filing systems. For social media platforms, that means Turkish regulatory exposure is two-layered: 5651 pushes toward in-country data measures and platform-specific obligations, while the KVKK governs lawful processing, transparency, security, and data-subject rights more generally.
Children’s services and user-rights obligations
Turkey has also expanded platform duties in relation to children and user rights. The BTK rules state that social network providers must take the necessary measures to provide differentiated services specific to children. For users who appear to be children, the platform must take into account the child’s age, the child’s best interests, physical, psychological, and emotional development, prevention of sexual abuse and commercial exploitation risks, high privacy settings and minimum data processing, and presentation of contracts, user settings, and data policies in a way children can understand.
The same rules also provide a distinct user-rights layer. Platforms must act equally and impartially among users, and they must provide users with the option to update preferences concerning recommended content and to limit the use of their personal data. This is notable because Turkish law is not only ordering platforms to remove unlawful content. It is also pushing them toward a more rights-aware account design and recommendation environment.
Failure to comply with obligations on data localization, child-specific services, user-rights protection, emergency safety sharing, information provision to BTK, and crisis planning can trigger administrative fines of up to 3% of the provider’s global turnover from the previous calendar year. That is a very serious sanction ceiling, especially for large multinational platforms.
BTK information requests and crisis planning
The BTK rules also give the Authority significant supervisory reach over platform systems. BTK may request all kinds of explanations regarding the platform’s compliance with the law, including its corporate structure, information systems, algorithms, data-processing mechanisms, and commercial attitudes, and the platform must provide the requested information and documents within three months of notification. Platforms must also prepare and notify BTK of a crisis plan concerning extraordinary situations affecting public security and public health.
This is important because it shows that platform regulation in Turkey is not limited to reactive takedown compliance. It includes ongoing supervisory visibility into systems, operations, and crisis-readiness. For platform counsel, that means Turkish risk analysis must extend beyond content moderation to governance, documentation, auditability, and institutional readiness.
Constitutional limits and the continuing Article 9 problem
Any article on Turkish platform liability must also address the Constitutional Court’s intervention. In its January 2024 press release, the Court explained that, in October 2023, it had annulled certain 2020 amendments to Law No. 5651 and held that the decision would take effect nine months after publication in the Official Gazette. The Court said the 2020 amendments to Article 8 that expanded administrative content-removal power were unconstitutional because final-type removal ordered by an administrative authority on the basis of an alleged offence and backed by administrative fines breached the presumption of innocence. It also stated that the 2020 changes to Article 9 restricted freedom of expression and freedom of the press and lacked adequate safeguards against arbitrary interference.
This matters directly to social media platforms because the platform complaint-and-response architecture in current legislation still references Articles 9 and 9/A, while the Constitutional Court has already identified serious constitutional defects in the 2020-amended Article 9 structure. As a result, the broad personality-rights-based removal and blocking pathway remains one of the most legally sensitive parts of Turkish internet law. For practical compliance, platforms still need to respond to qualifying applications and orders, but lawyers should verify the latest operative text and court practice before assuming that the old Article 9 model remains intact in every respect.

Representation, moderation workflows, complaint handling, transparency, ad-tech disclosure, judicial cooperation, child safety, data governance, and constitutional sensitivity all matter at once. In the Turkish market, platform liability is no longer only about what users post. It is also about how the platform is structured, how quickly it responds, what it reports, what it stores, and whether it can demonstrate accountable compliance when the regulator or the courts come calling.
